By participating, you agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Event Sponsor as final and binding as it relates to the Event and interpretation of these Official Rules.

Entries will be accepted starting on April 6, 2020 at 12:00:01 a.m. Pacific time and acceptance of entries will terminate on June 6, 2020 at 11:59 p.m. Pacific time (the “Event Period”).

To be eligible for this Event, an individual or representative of an organization must submit the entry via following methods:

      * When uploading, Tag @soonhariusa and include #soonharisong
      * You must only tag accounts mentioned in the event.
      * Do not incorrectly tag accounts that are not in the photo.

   4. Leave the comment “I love Soonhari” on the Soonhari Song Event Instagram post

Email:

• Create a video using the Soonhari Song (i.e. sing, lip sync, dance, etc.) and send it to soonharichallenge@gmail.com with your Facebook or Instagram ID. An easy way is to film using fun filter apps (ie. Snapchat, Instagram, Snow) and lip sync to the song.

An entry may not contain, as determined by the Event Sponsor, in its sole discretion, any content that:

– is sexually explicit or suggestive; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; or contains nudity;

– promotes irresponsible drinking, underage drinking, or the abuse of alcohol, use of illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;

– is obscene or offensive, or endorses any form of hate or hate group;

– appears to duplicate any other submitted entries;

– defames, misrepresents or contains disparaging remarks about other people or companies;

– contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors, or theme parks) owned by others, without their permission;

– contains any personally identifying information, such as personal names or e-mail addresses;

– contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without their permission;

– contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without their permission;

– contains look-alikes of celebrities or other public or private figures, living or dead;

– communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or

– violates any law.

The entry must be your original work, and may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If you incorporate any intellectual property owned by a third party into your entry, you do so at your own risk. If your entry contains any material or elements that are not owned or controlled by you, and/or which are subject to the rights of third parties, you are responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Event Sponsor in the manner set forth in these Official Rules. Event Sponsor reserves the right to request proof of these permissions in a form acceptable to Event Sponsor from you at any time. Failure to provide such proof, if requested, may render your entry null and void. If Event Sponsor is notified that any element of your entry infringes upon the rights of another person and/or receives a legally valid request to remove the affected entry from the Event social media accounts because of such infringement, such entry may be disqualified from the Event, as Event Sponsor may determine in its sole discretion. By submitting an entry, you represent, and warrant that you consent to the submission and use of the entry in the Event and to its use as otherwise set forth herein. Any entry that does not comply with these Official Rules will not be considered a valid entry in this Event. If any entry fails to comply with any of these entry requirements or any other provisions of these Official Rules, at the Event Sponsor’s sole discretion, Event Sponsor reserves the right to disqualify the you. Further, you will not be eligible to receive a prize unless Event Sponsor determines, in its sole and absolute discretion, that your entry has been or can be sufficiently cleared for legal purposes.

Any and all prize related expenses, including without limitation, any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. The winner may be required to submit a W9 or other tax form prior to receiving the prize.

First Prize (1 winner): MacBook Air (Approximate retail value: $999)
Second Prize (5 winners): iPad Generation 7 (Approximate retail value $329/iPad; total: $1,645)
Third Prize (15 winners): AirPods Generation 1 (Approximate retail value $159/AirPods; total: $2,385)
Participation Prize (All Entries): $10 Amazon e-Gift Card
Total approximate retail value of all prizes: $5,029 and Participation Prize value depends on the total number of eligible entries received.

Upon expiration of the Event Period, a panel of qualified judges, as chosen by the Event Sponsor in its sole discretion, will select a total of twenty-one (21) entrants in who receive the highest combined scores from the combined points awarded by all judges. The following criteria will be used to judge your entry (“Judging Criteria”):

• Creativity: How creative is the video in the interpretation and performance of the Soonhari Song (Maximum 100 points out of total 300 points)
• Quality: Overall quality of image, composition and editing (Maximum 100 points out of total 300 points)
• Popularity: How popular the submission was on the Soonhari SNS (Maximum 100 points out of total 300 points)

If there is a tie in the total combined score, the entrant whose entry receives the higher score for “Creativity” will be the winner. If there is still a tie, the judges will decide the winner. Event Sponsor will not announce the scores awarded to entry.

Winners of First, Second and Third prizes will be announced on June 15, 2020 via the Soonhari Facebook page and Instagram account.
By June 22, 2020, each winner of the First, Second and Third prizes will be contacted individually through the email address provided on the Entry Form that was submitted via the Event page at the Event Sponsor’s website at https://lottebeverageus.com/soonharichallenge. The completed Entry Form must include a mailing address and telephone number so that Event Sponsor can confirm the address and deliver the prize.
All entrants who will receive the Participation prize will be contacted via the email address provided on the Entry Form for delivery of the e-Gift Card.
All prizes for winners and participants who have responded to Event Sponsor’s winner announcement or email message will be and delivered by mail or email, as applicable out by July 6, 2020. Event Sponsor reserves the right to change the delivery method of the prize in its discretion.
Event Sponsor shall have no liability for a winner’s failure to receive notices due to the winner’s spam, junk e-mail or other security settings or the winner’s provision of incorrect or otherwise non-functioning contact information. Winners must submit an affidavit of eligibility and compliance with these Official Rules. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within seven (7) days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited, and an alternate winner selected. The receipt by a winner of the prize offered in this Event is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT EVENT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE EVENT AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED

By entering this Event you understand that Event Sponsor, anyone acting on behalf of Event Sponsor (including Event Agency), or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, link to, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Event (including written, photographic and audiovisual recordings, descriptions, or postings of events where a prize is redeemed), and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Event Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Event should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Event. In such case, Event Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Event Sponsor. Event Sponsor reserves the right at its sole discretion to disqualify any participant who tampers or attempts to tamper with the entry process or the operation of the Event or violates these Official Rules.

Event Sponsor has the right, in its sole discretion, to maintain the integrity of the Event, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by these Official Rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Event may be a violation of criminal and civil laws and should such an attempt be made, Event Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

By entering you agree to release and hold harmless Event Sponsor, Event Agency and their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Event and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Event; or (v) electronic or human error which may occur in the administration of the promotion or the processing of entries.

Winner acknowledges that except and to the extent that the Event Sponsor cannot by law exempt itself from responsibility or liability, the Event Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee described herein; including, but not limited to, quality, merchantability, mechanical condition or fitness for use. All warranties are hereby disclaimed, and the winner will accept the prize “as is”.

THIS EVENT IS GOVERNED BY THE LAWS OF UNITED STATES OF AMERICA AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW PRINCIPLES. As a condition of participating in this Event, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Event, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Los Angeles, California having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Event), and participant further waives all rights to have damages multiplied or increased.
